By registering yourself or your team, accessing, or using this website, you agree that your use of the site will comply with all local, national, and international laws. You represent that all information you provide to Diamond Showcase Events, LLC and/or diamondshowcaseevents.com is accurate and truthful. You have not accessed, and will not attempt to access, information you are not authorized to view or use. Such conduct constitutes unauthorized access, and Diamond Showcase Events, LLC reserves the right to pursue all available remedies. You also agree that you have not accessed, and will not access, files reserved solely for Diamond Showcase Events, LLC or diamondshowcaseevents.com administrators. To register for a college coach account, you must be an NCAA Division I, II, or III coach, a coach from another recognized collegiate athletic association, an assistant coach, and/or an official collegiate recruiter. To register for a high school or club team account, you must currently be employed by or working with the high school or club organization in the sport for which you are registering. To register as an athlete, you must be a high school athlete or a college student seeking to transfer to another university as an NCAA athlete. If you register falsely as an athlete, college coach, high school coach, or club coach, you may be held liable for your misrepresentation. You agree that you have not solicited, and will not solicit, other diamondshowcaseevents.com users or members. Soliciting registered diamondshowcaseevents.com users, including coaches or athletes, is strictly prohibited. Legal action may be taken against any person or company that solicits registered diamondshowcaseevents.com users. You may not use any Diamond Showcase Events, LLC and/or diamondshowcaseevents.com materials, including logos, graphics, artwork, text, articles, databases, internet coding, or similar content, without the express written permission of Diamond Showcase Events, LLC. Any translated documents provided by Diamond Showcase Events, LLC and/or diamondshowcaseevents.com are for personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any information or services obtained from Diamond Showcase Events, LLC and/or diamondshowcaseevents.com without the express written permission of Diamond Showcase Events, LLC. Diamond Showcase Events, LLC and/or diamondshowcaseevents.com is not responsible for the actions of users, including coaches and athletes, who fail to comply with NCAA regulations. Diamond Showcase Events, LLC and/or diamondshowcaseevents.com is not affiliated with the NCAA. All users are responsible for their own actions and for knowing and following NCAA rules, regulations, and laws. Diamond Showcase Events, LLC and/or diamondshowcaseevents.com is not responsible for coaches or athletes who violate NCAA or sport-specific governing body rules and regulations. Violators may have their accounts terminated. Diamond Showcase Events, LLC and/or diamondshowcaseevents.com does not promote violations of NCAA or sport-specific governing body rules or regulations. Diamond Showcase Events, LLC may terminate the membership or site access of any user it believes has violated these Terms of Service and Privacy Policy. Only actual collegiate athletic coaches may register for diamondshowcaseevents.com college coach accounts. Members, including coaches and athletes, agree to post only accurate and truthful information in their diamondshowcaseevents.com accounts. Diamondshowcaseevents.com is not responsible for any misrepresentation by an athlete, an athlete’s family, a coach, or a school. By registering with diamondshowcaseevents.com or using its services as a coach or athlete, you agree to the Diamond Showcase Events, LLC Terms of Service and Privacy Policy.

General

When you opt in to the service, we will send a message confirming your signup.

By opting in, you agree to receive recurring automated marketing and informational text messages from Diamond Showcase Events. These messages may be sent using an automatic system to the mobile number you provided at signup or to any other number you designate.

Message frequency varies. Additional mobile messages may be sent periodically based on your interactions with Diamond Showcase Events. Diamond Showcase Events may change the message frequency at any time, including increasing or decreasing the total number of messages sent. Diamond Showcase Events may change the phone number used to send messages.

Message and data rates may apply. If you have questions about your text or data plan, contact your wireless provider. Your wireless provider is not responsible for delayed or undelivered messages.

Your consent to receive marketing messages is not required as a condition of purchase.

Carriers

Carriers are not responsible for delayed or undelivered messages.

Cancellation

You may cancel at any time by texting “STOP.” After you send “STOP,” we will send a confirmation message that you have been unsubscribed, and no further messages will be sent. To receive messages from Diamond Showcase Events again, sign up again as you did initially.

Transfer of Number

Messaging Terms Changes

We may change or terminate our messaging program at any time. We may also update these Messaging Terms at any time. Changes take effect immediately when posted. Your continued enrollment after changes are posted means you accept the updated terms.

  1. Payment Obligation and Credit/Debit Card Authorization

By selecting the “accept terms and conditions” box, you agree to pay all fees you accepted on the date of acceptance. These fees may include, without limitation, showcase/tournament fees, camp fees, Hotel accommodation fees and any related charges. If you pay for a team to attend a showcase/tournament but do not meet the requirements, Diamond Showcase Events, LLC may, in its sole discretion, retain your tournament fee, and no portion will be refundable. If Diamond Showcase Events, LLC or its affiliates determine that your team is outside the approved hotel coverage area and does not reserve the required rooms for the event, you must pay the applicable hotel fee. Diamond Showcase Events LLC may also, in its sole discretion, prohibit your team from participating in that event or future events. If participation is denied for this reason, any money collected for those events will be forfeited.

You may purchase a product, good, or service from Diamond Showcase Events LLC or its affiliates using a valid credit card, debit card, or cash. The subscriber is responsible for all one-time fees and authorizes Diamond Showcase Events, LLC, its affiliates, and its payment processor to charge the subscriber’s credit card, debit card, or bank account for one-time or ongoing tournament, camp, hotel, or mandatory camper by electronic payment. You also authorize Diamond Showcase Events, LLC, its affiliates, and its payment processor to charge the credit card you provide for all amounts owed because of your registration, enrollment, or use of any product, good, or service offered by Diamond Showcase Events, LLC or its affiliates.

Tournament registration fees will be charged at agreed upon amount until the balance is paid in full. Camp registration fees will be charged at agreed upon amount per month after approval until the balance is paid in full. Payments will be processed between the 1st and 5th day of each month. Full payment must be received by 30 days before the tournament start date.

You represent and warrant, under penalty of perjury, that: (1) the credit card information you provide is true, correct, and complete; (2) your credit card company will honor the payments you make; (3) you will pay all charges incurred through your use of, registration for, or enrollment in any Diamond Showcase Events, LLC and/or diamondshowcaseevents.com products, goods, or services; and (4) if you are not the credit card account holder, you are an authorized user of the card or have permission from an authorized user, including but not limited to a parent, sibling, other blood relative, or close personal relation.

 

To help prevent fraud, Diamond Showcase Events, LLC may verify the credit card information you provide. This verification may include debiting an amount between $0.01 and $0.99 from your credit card account and then crediting the same amount back or otherwise canceling the transaction. We may also ask you to confirm the debited amount to verify that you possess the card. Diamond Showcase Events, LLC will use this process only to screen for fraud and will not otherwise debit your credit card account except for transactions made through your account for our Service. By providing your credit card information, you authorize Diamond Showcase Events, LLC to debit and credit your account for an amount less than one dollar for verification purposes.

All fees exclude taxes and duties imposed by governing authorities. You are solely responsible for paying any applicable taxes and duties.

  1. Cancellation

We may cancel any event for any reason up to two weeks before the event’s first day. For example, we may cancel an event if the minimum number of participants or required college coaches is not reached. If this occurs, we will notify you as soon as practical and, if available, offer an alternative Diamond Showcase event, tournament or camp of comparable value. If an event is canceled, Diamond Showcase Events, LLC is “without liability.” Whenever used in this Agreement, “without liability” means Diamond Showcase Events, LLC will not owe liquidated damages, refunds, attrition fees, termination fees, cancellation fees, rental charges, travel fees, change fees, service charges, reimbursements, direct or indirect damages, compensatory damages, consequential damages, special or incidental damages, or any other amounts of any kind.

Diamond Showcase Events, LLC is also “without liability” when our contractual obligations are prevented or affected by force majeure. This means we will not provide compensation or refunds if we cancel or change a camp, tournament, or any part of a Diamond Showcase Events event because of unusual or unforeseeable circumstances beyond our control. Force majeure includes, without limitation: (1) acts of God; (2) war, armed conflict, threats of war, riots, or civil or political unrest; (3) strikes or labor or industrial disputes at the venue or event area; (4) disease at the venue or in the event area, including SARS or Legionnaires’ disease; (5) government regulations or advisories, including travel warnings; (6) civil disturbance at the venue or event area; (7) threatened or actual terrorist activity in the United States and its consequences, as substantiated by government warnings or advisories; (8) closure of ports or airports, air traffic control delays, transportation technical problems, transportation curtailments, or other force majeure circumstances that would materially affect attendees’ ability to attend; (9) natural or nuclear disasters, fire, earthquake, hurricane, rain, hail, lightning, or other acts of nature or adverse weather conditions; (10) inclement weather in the event area that causes the venue manager to deem the contracted venue unusable; (11) shortages or disruptions of electrical power or other essential utilities in the event area, including blackouts or rolling blackouts; (12) cancellation for safety reasons as determined by an authorized person, including Diamond Showcase Events staff, venue staff, or umpires; and (13) any other cause reasonably beyond the parties’ control that makes the event commercially impracticable, illegal, or impossible to perform fully as originally contracted. In such cases, Diamond Showcase Events may terminate this Agreement without liability.

  1. College Coach Guarantee

Each college coach listed on the event or camp pages of our website has visited the site, completed the college coach form, and selected the events they wish to work or instruct. If any listed coach does not attend or work a camp or event, Diamond Showcase Events, LLC is not responsible or at fault. You agree to hold Diamond Showcase Events, LLC and its officers, directors, employees, agents, and affiliates harmless from any related damages. You also understand that you are not entitled to any refund or credit if a coach does not attend or work the camp or event.

  1. Diamond Showcase Events Refund Policy

Players and teams registered for a Diamond Showcase Events are not eligible for refunds or credits for any reason, including rainouts or force majeure. Diamond Showcase Events, LLC may cancel an event because of inclement weather or force majeure. Inclement weather will be determined in Diamond Showcase Events, LLC’s sole discretion and generally includes excessive heat or cold, ice, snow, freezing rain, wind, and heavy rain before or during the event. If force majeure or a rainout makes the facility or fields unavailable before the event begins, Diamond Showcase Events, LLC may reschedule the event or replace it with an equivalent or better event, and no refund will be provided. If rescheduling is allowed, Diamond Showcase Events, LLC will contact you and reschedule you for another available date in the same calendar year. If you refuse any newly proposed event, your event date and experience will be considered completed. If inclement conditions occur after the event begins, the event may be temporarily interrupted and resumed later the same day. If the event cannot be fully completed because of lack of time or continuing adverse conditions, no refund or credit will be issued for the incomplete portion. Any delay or extension caused by rainout or force majeure does not entitle you to a dispute, discount, refund, credit, or rebate.

  1. Affiliate Program

Anyone may join our affiliate program. Unless otherwise approved by a member of the diamondshowcaseevents.com affiliate staff, affiliates may use their affiliate link only in email or as an image or text link. After someone uses your affiliate link to visit our site, that person must sign up within 30 days for you to earn a referral fee. The following provisions address misuse of affiliate links. By registering as a Diamondshowcaseevents.com affiliate, you accept the terms below.

If an affiliate uses email to identify or target potential customers, the affiliate acknowledges that they have read, understand, and will comply with all provisions of the federal CAN-SPAM Act enacted on January 1, 2004, and any updates, changes, or modifications to that Act. Any affiliate who fails to comply with the Act or who distributes an affiliate link in an inappropriate manner will have their account terminated immediately and will forfeit all affiliate referral fees. Any affiliate who violates the Act must defend, indemnify, and hold harmless Diamond Showcase Events, LLC and its officers, directors, employees, agents, and affiliates against any third-party claim or penalty arising out of or related to the affiliate’s email practices. The affiliate must pay any award against Diamond Showcase Events, LLC and/or its officers, directors, employees, agents, and affiliates, as well as any reasonable costs and attorneys’ fees incurred because of such claim resulting from the affiliate’s noncompliance.

Affiliates are not prohibited from bidding on search-engine keywords that apply to the Diamond Showcase Events, LLC trademark or represent misspellings or variations of our brand name, including Diamondshowcaseevents.com, Diamond Showcase Events, LLC, and diamondshowcaseevents.com. Affiliates who violate Diamond Showcase Events, LLC’s Terms of Service or behave in a manner Diamond Showcase Events, LLC considers wrongful will receive a warning. Diamond Showcase Events, LLC also reserves the right to withhold any and all commissions associated with those affiliates. Affiliates with questions about appropriate behavior or use of their affiliate link should consult diamondshowcaseevents.com first.

  1. Legal Disclaimer

Your access to and continued use of the Diamond Showcase Events, LLC website means you accept all provisions stated here. If you do not agree, you should stop using the site and exit immediately.
